Skillful Enforcement Revives Thousands of Tons of Fertilizer

Gangbei District People’s Court of Guigang City Successfully Enforces a Contract Dispute Case

Guigang News (Reporter Liang Jiajun, Correspondent Teng Jiejie, Lu Yang, Huang Jingna) Recently, the Gangbei District People’s Court of Guigang City successfully resolved a contract dispute case. The enforcement judge used flexible enforcement methods to facilitate a handshake between the parties, smoothly “reviving” more than 1,300 tons of compound fertilizer, thereby safeguarding the legitimate rights of the victorious company, while minimizing the impact of enforcement on the company’s production and operation, injecting judicial warmth into optimizing the business environment.

In 2022, a certain industrial company signed a purchase contract for compound fertilizer with a fertilizer company. Later, disputes arose over fertilizer quality issues. The fertilizer company refused to deliver goods or make payments due to substandard quality and sued the industrial company in court, demanding the return of the prepayment. The industrial company insisted that the fertilizer quality met the agreement and filed a counterclaim, requesting the court to order the fertilizer company to accept the goods, pay the remaining over 2.98 million yuan, including interest, and compensate for storage losses.

After the first instance at Gangbei District Court and the second instance at Guigang Intermediate People’s Court, the final judgment ordered the fertilizer company to accept and take out the 1,300 tons of compound fertilizer within a specified period, and to pay the remaining amount, interest, and storage losses. After the judgment took effect, the fertilizer company neither paid nor cooperated with the acceptance and delivery, resulting in the backlog of over 1,300 tons of fertilizer in the warehouse. The responsible person of the industrial company then applied to the court for compulsory enforcement.

After the case entered enforcement procedures, the enforcement judge promptly initiated property investigation and control procedures, lawfully served enforcement notices and property reports to the fertilizer company, and froze or seized its bank accounts and real estate. Meanwhile, the enforcement judge reviewed the case and found that the large quantity of fertilizer involved meant that forced delivery could significantly reduce the value of the goods and exacerbate conflicts between the parties, potentially leading to new legal disputes.

“Enforcement is not simply about ‘one enforcement solves it,’ but about substantively resolving conflicts and protecting enterprise development.” Upholding this principle, the enforcement judge adopted a “back-to-back legal explanation + face-to-face negotiation” approach, separately interviewing both parties, explaining the legal consequences of refusing to comply with the judgment to the fertilizer company’s responsible person, and guiding the industrial company to balance enforcement efficiency with practical business development, and to rationally negotiate a solution.

As the opposing emotions gradually eased, the enforcement judge organized multiple negotiations, focusing on the core issue of “fertilizer disposal,” and crafted an enforcement plan that balanced both parties’ interests. Ultimately, both sides reached an agreement: the fertilizer company would transfer its rights and obligations to accept and take out the goods at the price corresponding to the payment, offsetting the amount owed; the remaining payment, interest, and storage losses would be paid in full by the fertilizer company in one lump sum; after payment, the fertilizer involved would be disposed of by the industrial company, and both parties agreed that there would be no further disputes over this case.

After finalizing the plan, the enforcement judge helped both parties refine the settlement agreement, clarifying key details such as payment deadlines and performance confirmation. Both voluntarily signed the enforcement settlement agreement. The fertilizer company paid all the owed funds as agreed, fulfilling all obligations determined by the judgment. The industrial company submitted a case closure application to the court on the same day, and this enterprise enforcement case was successfully concluded.

Currently, both companies have resumed normal production and operation.
