50-Year-Old Female Employee Forced into Retirement Awarded 940,000 Yuan Compensation

Female employee Zhang, born in 1974, joined a company in 2019. In September 2024, the company unilaterally terminated her employment contract on the grounds that she was “50 years old and reached the statutory retirement age.” Zhang disagreed, believing she held a management position and the statutory retirement age should be 55. She submitted a notarized screenshot from the company’s official website showing her listed as “management personnel.” The company argued she was not in a management role but failed to provide strong evidence to the contrary.

Both arbitration and the court recognized that the website information has evidentiary value, and Zhang was indeed in a management position. The company’s termination of her contract before she turned 55 was deemed illegal. The final judgment ordered the company to pay Zhang over 942,000 yuan in compensation for illegal termination and 10,000 yuan for unused annual leave wages.

According to national regulations, starting January 1, 2025, the retirement age will be gradually delayed. For female employees whose original statutory retirement age is 55, it will be delayed by one month every four months until reaching 58. For female employees whose original statutory retirement age is 50, it will be delayed by one month every two months until reaching 55.
