Classic Penguin Clothing Brand Original Penguin Sues Pudgy Penguins for Trademark Infringement

Gate News, March 6 — The parent company of the classic penguin clothing brand Original Penguin/Penguin, PEI Licensing, has officially sued Pudgy Penguins Inc., accusing it of trademark infringement and brand dilution. PEI claims that Pudgy Penguins uses names such as “Pudgy Penguins,” “Pengu Nation,” and “Forever Pudgy Penguins,” along with penguin-related logos on retail products like clothing, hats, hoodies, and plush toys, which easily cause consumer confusion and lead to the mistaken belief that the two are related. Despite PEI sending a cease-and-desist letter in October 2023, Pudgy Penguins continues to produce and sell related products.

Pudgy Penguins originally launched as an Ethereum NFT project in 2021 and successfully transitioned into physical merchandise. Starting in 2023, it has been selling plush toys at major retailers like Walmart and Target, with sales surpassing one million units in a short period and expanding into clothing. The Original Penguin brand dates back to 1955 and has a long history. PEI is seeking compensation from Pudgy Penguins for all infringing profits, its own damages, and other losses. Pudgy Penguins has not yet publicly responded to the lawsuit.
