该动议于 2 月 5 日起草，周二在曼哈顿联邦法院正式立案，由 SBF 母亲、斯坦福大学退休法学教授 Barbara Fried 递交。目前，三名法官组成的上诉小组正在审理其整体上诉，他认为审判阶段的部分裁决影响了最终判决结果。
