此前，Chastain 因利用职务之便购买即将在 OpenSea 主页展示的 NFT，并在价格上涨后出售获利，于 2023 年被判电信欺诈和洗钱罪。然而，联邦上诉法院于今年 7 月推翻该判决，认为陪审团接受了错误指示，且 NFT 主页数据不具商业价值，不符合联邦电信欺诈法下的财产定义。
曼哈顿美国检察官 Jay Clayton 表示，考虑到 Chastain 已服刑三个月，且同意不对价值 47,330 美元的 15.98 个以太币的没收提出异议，决定不再重审此案。
