Berkovitz's claim; It paves the way to classify Ether, which is regulated by the SEC and CFTC, as both a security and a commodity.



Ether, whose legal status has been discussed by the CFTC and SEC for a long time, was eventually defined by the CFTC as a commodity like many other cryptocurrencies. However, the SEC, headed by Gary Gensler, has yet to assign a specific legal category and class to Ether. Gensler stated at a meeting in April that everything other than Bitcoin should be considered a security without much explanation.
