不適用範例：持有比特幣加上「比特幣 ETF 場外（OTC）買權」的信託，若計入 OTC 選擇權的總名目價值後，合格資產比例只剩約 71%，未過 85% 門檻。
另外，NFT 與收藏品（collectibles）被明確排除在「商品」定義之外，理由是當初制定通用標準時並未涵蓋這類資產。
後續：SEC 審查路徑與意見徵求
SEC 對自律組織（SRO）的規則提案有三種處置選擇：核准、駁回、或開啟審議程序（institute proceedings），無固定時限。News.Bitcoin.com 報導稱目前提案處於公開徵求意見階段。
